These terms and conditions apply to all reservations, rental transactions, deliveries and services offered through Bonaire Beach Essentials.

1. Definitions

In these terms and conditions, the following definitions apply:

  • Rental Provider: Bonaire Beach Essentials, located in Kralendijk, Bonaire.

  • Renter: any natural person or legal entity renting products through Bonaire Beach Essentials.

  • Products: all rental items, including but not limited to beach chairs, umbrellas, coolers, snorkel sets, tables, BBQs and beach packages.

  • Agreement: any reservation or rental agreement between the Rental Provider and the Renter.

2. Applicability

  1. These terms and conditions apply to all offers, reservations, agreements, deliveries and services of Bonaire Beach Essentials.

  2. By placing a reservation, the Renter agrees to these terms and conditions.

  3. Any deviations from these terms and conditions are only valid if agreed in writing.

  4. If one or more provisions are found to be invalid, the remaining provisions will remain fully in force.

3. Reservations

  1. Reservations can be made online, via WhatsApp or by email.

  2. A reservation is final once it has been confirmed by Bonaire Beach Essentials.

  3. Bonaire Beach Essentials reserves the right to refuse or cancel reservations without stating reasons.

  4. Obvious errors or mistakes in offers, prices or communication are not binding on Bonaire Beach Essentials.

4. Rental Period

  1. The rental period starts at the agreed time of delivery and ends at the agreed time of collection or return.

  2. Extension of the rental period is only possible with prior permission and subject to availability.

  3. In case of late return, additional rental fees and additional costs may be charged.

  4. If products are not returned, Bonaire Beach Essentials may charge the full replacement value.

5. Delivery and Collection

  1. Bonaire Beach Essentials offers delivery and collection service on Bonaire.

  2. Delivery takes place at the address or location provided by the Renter.

  3. Stated delivery times are indicative and do not constitute strict deadlines.

  4. The Renter must be present at the agreed time of delivery and collection.

  5. If delivery or collection is not possible due to the Renter, additional costs may be charged.

  6. Bonaire Beach Essentials is not liable for delays caused by traffic, weather conditions, force majeure or other external circumstances.

6. Prices and Payment

  1. All listed prices are in United States dollars (USD), unless stated otherwise.

  2. Payment must be made in the manner indicated by Bonaire Beach Essentials.

  3. Bonaire Beach Essentials reserves the right to change prices at any time.

  4. Any taxes, surcharges, delivery fees or additional costs will be communicated in advance as far as reasonably possible.

  5. In case of late payment, statutory interest and collection costs may be charged.

7. Deposit

  1. In principle, no deposit is required.

  2. Bonaire Beach Essentials reserves the right to request a deposit in specific cases.

  3. Any deposit may be used to offset damage, loss, theft, cleaning costs or outstanding amounts.

8. Use of the Products

  1. The Renter must handle the rented products with care.

  2. The products may only be used for their intended purpose.

  3. The products may not be subleased or made available to third parties without permission from Bonaire Beach Essentials.

  4. The Renter is responsible for loss, theft, damage and improper use of the products throughout the entire rental period.

8.5 Use Entirely at Own Risk

Use of all products rented from Bonaire Beach Essentials is entirely at the own risk of the Renter and all persons using the products.

8.6 Responsibility of the Renter

The Renter is fully responsible for:

  • safe use of the products;

  • supervision of children and third parties;

  • compliance with local laws and regulations;

  • assessing whether the products are suitable for the intended use and circumstances.

8.7 Public Locations

Rented products may not be left unattended on beaches, in public locations or in any other publicly accessible places.

9. Damage, Loss and Theft

  1. Any damage, defects or missing items must be reported to Bonaire Beach Essentials immediately.

  2. In case of loss, theft or irreparable damage, the full replacement value of the product may be charged to the Renter.

  3. Normal signs of use do not constitute damage.

  4. Repair, cleaning, transport and administration costs may be charged additionally.

  5. The Renter remains liable until the products have been collected or received by Bonaire Beach Essentials.

10. Liability and Indemnification

10.1 Full Exclusion of Liability

Bonaire Beach Essentials is, to the fullest extent permitted by law, not liable for any direct damage, indirect damage, consequential damage, immaterial damage, business loss, loss of revenue, personal injury or any other damage arising from or related to:

  • the use of rented products;

  • incorrect or improper use;

  • weather conditions;

  • defects that were not reasonably visible;

  • theft, loss or damage to property;

  • bodily injury;

  • death;

  • beach, sea or traffic situations;

  • delays in delivery or collection;

  • temporary unavailability of products;

  • technical failures;

  • force majeure situations;

  • acts or omissions of third parties.

10.2 Own Responsibility

The Renter expressly acknowledges that:

  • beach, water and outdoor activities involve risks;

  • use of BBQs, coolers, beach chairs, umbrellas and other materials is entirely at the Renter’s own responsibility;

  • Bonaire Beach Essentials does not supervise the use of the products.

10.3 Indemnification

The Renter fully indemnifies Bonaire Beach Essentials against all:

  • third-party claims;

  • damage claims;

  • fines;

  • costs;

  • legal proceedings;

  • attorney fees;

arising from the use of the rented products by the Renter or by third parties.

10.4 No Warranties

Bonaire Beach Essentials provides no express or implied warranty whatsoever regarding:

  • suitability for a particular purpose;

  • availability;

  • weather resistance;

  • safety for specific applications;

  • uninterrupted use.

10.5 Limitation of Liability to the Legal Minimum

If Bonaire Beach Essentials is nevertheless held liable despite the above, its liability is limited to a maximum of the rental amount actually paid by the Renter for the relevant reservation.

10.6 No Liability for Personal Belongings

Bonaire Beach Essentials is never liable for loss, theft or damage to personal belongings of renters or third parties, regardless of cause or location.

10.7 Use by Third Parties

The Renter remains fully liable for everyone who uses the rented products through or with the Renter.

10.8 Local Conditions

Bonaire Beach Essentials is not liable for damage caused by:

  • wind;

  • sun;

  • salt water;

  • sand;

  • sea conditions;

  • animals;

  • natural influences;

  • traffic situations;

  • public locations or beaches.

11. BBQs and Fire Safety

  1. BBQs may only be used in permitted locations.

  2. The Renter is responsible for the safe use of fire, gas, charcoal and hot materials.

  3. Any fines, claims or damage resulting from improper use are entirely at the expense of the Renter.

12. Cancellation

  1. Cancellations must be communicated as soon as possible by WhatsApp or email.

  2. In case of cancellation less than 24 hours before the start of the rental period, Bonaire Beach Essentials reserves the right to charge costs.

  3. In case of extreme weather conditions or force majeure, Bonaire Beach Essentials may modify or cancel reservations without being liable for any damage or compensation.

13. Force Majeure

Bonaire Beach Essentials is not liable for delays, cancellations, damage or failures caused by force majeure, including but not limited to:

  • natural disasters;

  • extreme weather conditions;

  • power outages;

  • government measures;

  • strikes;

  • transport problems;

  • internet or communication failures;

  • illness;

  • pandemics.

14. Privacy

  1. Personal data is used exclusively for reservations, communication and service provision.

  2. Bonaire Beach Essentials does not provide personal data to third parties unless this is necessary for the performance of the agreement or legally required.

15. Applicable Law

  1. These terms and conditions are governed by the laws of the Caribbean Netherlands.

  2. Disputes will be submitted exclusively to the competent court on Bonaire.
